TERMS AND CONDITIONS FOR ONLINE SALES OF TICKETS
1. Terms and Conditions for online sales of tickets and ( further refer to as “Online Terms and Conditions” or “OTC” ) are the specific regulations for online transactions only and an integrant part of the Cinema City General Terms and Conditions (GTC). Before you purchase your tickets, please get acquainted also with the full General Terms and Conditions as they are the general framework applicable and mandatory for all Customers and complete the present OTC. They are published on the website www.cinemacity.rо (the "Website") and placed within cashiers’ desks in multiplexes at Customers’ disposal, as specified in GTCs.

2.These Terms and Conditions for online sales of tickets for film screenings in Cinema City multiplex cinemas shall apply to the relations between Cinema City and all of its Customers in connection with the online sale of tickets for film exhibitions and shall have effect in respect of all multiplexes operated by Cinema City. They are published on the website www.cinemacity.rо (the "Website") and placed within the multiplexes at Customers’ disposal as specified in GTCs.
3. The present OTCs are part of the Contract for online purchase of tickets between Cinema City and each Customer. The Customer shall be bound by the abovementioned rules from the moment he has marked “Accept” button near the field: “I have read and agree to Cinema City's Terms and Conditions " of the online platform for ticket sales on the Website of the Company. The purchase of online tickets for a movie or other special event / screening is considered a contract for provision of services of leisure activities, through which the Company undertakes to provide this service at a certain time or within a certain period and, as such, the Customer cannot withdraw from this contract pursuant to art. 16 lit. l) of the Government Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with traders, as well as for amending and supplementing some normative acts, with subsequent amendments.
4. If the Customer does not agree with the Online Terms and Conditions, he might express his disagreement by refusing to check the “Accept” button and the purchase will not be finalized. In such situation, the Customer can buy tickets only at cashiers’ desks in the Cinema City multiplexes, with respect of the GTCs.
PRICES AND DISCOUNTS
5. Ticket prices for the movies screened in different multiplex cinemas operated by the Company, are listed on the Website, in "Summary & Prices" section.
6. The voucher, promotional code, access card, contest ticket, marketing tickets are not electronically purchased tickets and they are subject to the applicable rules set forth in GTCs and/or other type of rules.
7. Categories of shows for which tickets can be purchased online are:
• Movies running in standard, IMAX or 4DX cinema halls;
• Movies running in the VIP cinema halls;
• Other alternative shows, such as Cinema Theatre;
8. All prices given on the Website are in Romanian lei/RON. Cinema City reserves the right, without notice, to change ticket prices from time to time, at its solely discretion. The tickets already bought shall not be affected of the price changing. The prices presented on the Website are the end prices, inclusive of all taxes and duties and excluding the exceptions on surcharges when buying glasses mentioned in GTCs and Cost of the online service fee mentioned below.
9. Cost of the online service fee. For online ticket purchase service, a convenience fee for processing the Customer’s online order shall be paid by the Customer for each purchased ticket in the amount expressly indicated next to the ticket price in Step 1 "Ticket Selection" on the online platform for ticket sale on the Website of the Company. Cinema City reserves the right, without notice, to change from time to time the value of the Cost of the Online Service fee, at its solely discretion. The Cost of the online service fee for the tickets already bought shall not be affected of the change.
10. Cost of the online service fee is charged for the maintenance of the online ticket purchase system, the processing of the Customer’s order and the option for advance choosing of seats in the cinema halls. The Cost of the online service fee helps Cinema City to maintain and improve the online purchase system.
11. The final amount to be paid for the online ticket comprises of the price of the ticket plus the online Cost of the online service indicated next to the ticket price in Step 1 "Ticket Selection" mentioned in point 9. If doesn’t agree paying the online Cost of the online service, the Customer has the option to purchase the ticket at the cashiers’ desks in the cinema multiplexes. In case of the ticket’s refund according to the procedure set out in the present OTCs, the Cost of the online service is not refundable.
STEPS OF THE ONLINE TICKET PURCHASE PROCEDURE
12. In order to online purchase tickets for a film screening, the Customer must access the Company’s Website: www.cinemacity.ro. No pre-registration on the Website is required.
13. A maximum number of 10 tickets/ticket type can be purchased upon each online transaction. The payment resulting from a single order shall be made once, fully and shall cover all the ordered tickets.
14. To purchase ticket(s), the Customer must go to the "Program" section of the website or select a movie from the company's website and follow the following steps:
STEP 1:
If you started from the "Program" section - select a multiplex cinema, the date and the movie and then press the desired time to watch the movie;
or
If you initiated the process by directly selecting a movie - choose a multiplex cinema and the date and then press the desired time to watch the movie;
STEP 2:
Select the following buttons:
• Buy ticket
and press the "Next" button.
STEP 3: Selecting the type and number of tickets you want;
STEP 4: Selecting seats in the desired cinema hall;
The customer cannot leave an empty place next to the selected positions (variance between the selected positions and the rest).
Please note that once you have selected your seats, you have 10 minutes to complete your order and make your payment successfully. Expiration of the respective limits results in the unblocking of seats, and the purchase of tickets must be restarted by the Customer.
Please note that Cinema City bears no responsibility for wrongly entered email address as our system does not inspect or verify it. The customer is fully responsible for the correctness of all types of data provided during the ticket purchase process.
STEP 5: Enter a name, surname and email address. The email address is required to enable Cinema City to send you order confirmation and e-tickets purchased and to contact you in the event of a change in viewing time and/or unexpected cancellation.
Before clicking the "Next" button and being redirected to the website of the PayU payment service provider to pay for your order, please check it carefully. If you agree with your order, check "I have read and agree to Cinema City's Cinema City's General Terms and Conditions and then press the "Next" button.
Before placing an order, it is important for the Customer to ensure that the location of the multiplex cinema, the film, the time, the cinema hall and the seats selected are the desired ones, as it will not be possible to exchange or refund tickets in the event of a mistake.
After pressing the "Next" button, the Website redirects the Customer to the website of the payment service provider PayU, to pay for the tickets by card payment. If you do not agree to pay through the PayU payment processor, you have the option to purchase tickets directly from the Cinema City box office without the possibility of booking online tickets.
STEP 6: On the PayU website, the Customer will fill in their payment card details and press the "Pay Now" button. By pressing the virtual button "Pay now", the Customer confirms that his order is correct and is bound by a payment obligation and pays the price of the ordered tickets together with the Cost for the online service for processing the order.
After pressing the "Pay now" button, which confirms the payment with the card by the Customer, this payment is implemented in the banking system.
15. Payment of the electronic tickets ordered by the Customer is required in order for the ticket to be issued and delivered to the Customer. The payment must be made within maximum 10 minutes as of the order placement. Upon the expiration of the payment deadline without the Customer making the payment, the seat will be released and Customer must start over for a new ticket purchase. The commissions and bank fees charged by the Customer's bank for online transactions fall exclusively on the Customer.
16. After successful completion of the electronic transaction, the Customer shall receive an e-mail to the e-mail address of contact (e-mail) specified in the order /please check your Spam/Junk folder in you cannot find the email in Inbox/ – representing confirmation of the transaction by Cinema City with the registration number of the order and the corresponding number of the electronic tickets purchased by Customer, as well as a link to the GTC (General Terms and Conditions ) and OTC (General Terms and Conditions for online sale). If he does not receive confirmation of his order, the Customer must fill in the contact form on the Company's Website under "Contact Us" section, or to write us at the e-mail address [email protected] or to call 021.301.09.06 every weekday /Monday – Friday/, between 10:00 a.m. and 5:00 p.m.
17. By using the "e-ticket" online purchase option, the Customer will avoid queuing at the box office. The customer will bring the e-ticket on their smartphone or similar device to be scanned by one of our cinema attendants.
18. Accepting the General Terms and Conditions (GTC).including the Online Terms and Conditions, the Customer expressly agrees that the distance contract concluded with Cinema City will be sent to the e-mail address provided by him. The Customer is bound by the online ticket purchase contract from the moment they press the virtual "Pay Now" button and make the payment, and Cinema City is bound by the contract from the moment it receives a confirmation of the order made and its payment by the Customer.
19. Access to the cinema halls is made either on the basis of the tickets issued at the ticket offices or on the basis of the "electronic ticket" bought online.
20. If the Customer discovers any deficiencies in the use of the order form for online sale of tickets placed on the website, which prevents him/her from making the purchase online, the Customer has the possibility to contact the Company at the e-mail address: [email protected], in order to solve the impossibility or difficulties encountered in the process of buying tickets online. For additional information, the telephone number: 021.301.09.06 and the email – [email protected], are made available to the Customer, between 10:00 a.m. and 17:00 p.m. Monday to Friday.
METHOD OF PAYMENT
21. Payment of electronic tickets ordered by the Customer is done via the payment service provider PayU S.A., Poland, using one of the specified on the platform of online payment bank cards type - VISA, MASTERCARD and MAESTRO. The security of card data is guaranteed by PayU S.A., processing the payment. The Customer provides card data and authentication data only on the website for online card payments of PayU, and Cinema City hasn’t access to the contents of confidential data exchanged between the cardholder, PayU and the company issuing the card. Cinema City does not get information about your card details, nor is it responsible for its protection from unauthorized access. Considering that the credit card payment service is not provided by Cinema City, the company is not liable for the provision and quality of the service.
USE OF THE TICKET PURCHASED ONLINE
22. Each ticket purchased online is valid only for the specified therein multiplex cinema and film, cinema hall, seats in the cinema hall, date and time of the screening mentioned on the ticket.
23. The holder of an electronic ticket is not entitled to any servicing advantage at the entrance in the cinema/cashiers’ desks/café/buffet and shall wait for his turn along with the rest of the Customers.
24. Each ticket entitles the attendance of only the screening marked on it, on the date and at the time specified, and in the cinema hall designed by Cinema City for this screening. The duration of the Customer’s visit to the cinema hall is determined by the duration of the screening. Immediately after the screening the client is obliged to leave the hall even if he has a ticket for the next immediate screening in the same cinema hall.
25. Customers are obliged to keep their tickets from the time of their purchase until the end of the screening they refer for and leaving the multiplex cinema. Cinema City is not responsible for deleted, stolen, lost, destroyed or damaged tickets and has no obligation to reissue them, refund the amount paid for them, the Cost of the online payment service and the price paid for 3D glasses or to provide any other compensation.
RESTRICTIONS FOR USE OF ONLINE PURCHASED TICKETS
26. When choosing a movie to purchase online tickets for, Customers must consider the age restrictions arising from the categorization of films by National Center of Cinematography, as described in the GTCs. The access of persons under the age of 18 years to the cinema halls of Cinema City shall be subject to the rules specified in the General Terms and Conditions (GTC).. Respect for the rules imposed by CNC when purchasing online tickets is entirely the responsibility of the Customer.
27. In order to respect the rules imposed by CNC, Cinema City is entitled to check the age of the Customers with online tickets in order to verify whether the age requirements resulting from the categorization of films are fulfilled. The checks are to be done during the online ticket inspection and the access of the Customer to the film screening. Cinema City may deny access to a screening of a Customer whose age does not meet the requirements resulting from the film categorization, even if the ticket is already bought. In such case Cinema City shall neither be obliged to refund the price paid by the Customer for the online ticket, the 3D glasses and/or the Cost of the online payment service, nor exchange the ticket with a ticket for the screening of another film, nor shall provide any other compensation. Also, Cinema City is not obliged to compensate or refund the money to the Customer for any products from the café/buffet purchased to be consumed inside cinema hall he is denied access to.
28. When choosing a ticket category (at a discounted price) Customers should consider whether they meet the requirements for obtaining discounted tickets. During the inspection of an online purchased discounted ticket before admission of a Customer to the cinema hall, the Customer is obliged to provide Cinema City personnel with a document certifying the right to use the discount. Failure to provide such a document or establishment that the Customer is not eligible to obtain a discounted ticket is a sufficient ground for Cinema City to refuse the Customer access to the screening with the purchased discounted ticket.
29. The person who has bought a discounted online ticket may not exchange it or grant it to another person unless such other person meets the requirements to receive a discounted ticket of the same category. If, however, such acts have been carried out the person acquiring discounted online ticket without being entitled to purchase such one for his own reasons shall not be allowed to the screening the online ticket refers to.
30. Cinema City is entitled to refuse access to film screenings in cases of submission of an invalid online ticket – a ticket that has not been paid for or that is tampered, illegible, false or manipulated in any way. Only persons who present a undeteriored valid online purchased ticket shall be given access to film screenings.
CANCELATION OF THE ONLINE PURCHASED TICKETS
31. The online order that includes more than 1 ticket purchased online through the same transaction cannot be modified, exchanged, returned, nor can the number of entrance tickets included in it be reduced or be revalidated for other movies, dates, times or screenings, but for the reasons specified in the present OTC. Tickets purchased together, through the same electronic transaction, are considered as a whole and any change allowed to any of them automatically affects the other tickets included in the order. Cancelation of a ticket from a single order will automatically cancel the entire order. Also, in case of Family Packages, the cancellation of a single ticket in the package entails the cancellation of the entire package.
32. Customers have the right to cancel tickets purchased online via their MyCinemaCity account or via the mobile application available in the App Store or Play Store, up to 2 hours prior to the start of the movie for which the ticket was purchased. The purchase price of the screening ticket will only be refunded to the bank account from which it was paid.
The cost of the order processing fee referred to in point 9 will not be refunded. Tickets purchased online via the Cinema City website in visitor mode (without having been purchased via the MyCinemaCity account or mobile application) are subject to the cancellation procedure for tickets physically purchased at the box office, i.e. no later than 2 hours prior to the start of the screening for which the tickets were purchased.
In order to exercise their rights under this paragraph, customers must present the valid Online Ticket purchased for the screening to Cinema City and complete and sign a "Cancellation and Refund of Online Ticket" form at the multiplex for which the ticket was purchased.
As with tickets purchased physically at the box office, customers may only cancel their tickets at the multiplex for which they were purchased, and no later than 2 hours prior to the start of the screening for which the tickets were purchased. In order to exercise their rights under this paragraph, customers must present Cinema City with a valid ticket for the screening and complete and sign a ticket cancellation and refund form at the multiplex for which the ticket was purchased.
33. In case the screening is terminated or canceled for technical reasons or any other reasons attributed to Cinema City, the Company is responsible for:
• the Customer, at his request, will be refunded the price of the electronic ticket on the bank account from which the amount has been paid; under no circumstances the refund payment will be done on a different bank account of the Customer from the one the payment was made from; This option is possible only in case the movie haven’t started yet and with strictly respect of the point 32 herein.
or
• the Customer will be issued a voucher of the same value as the price of tickets purchased;, excluding the amount of the Cost of the online payment service; This option is possible in case the movie has started and / or cancellation happens with less than 30 min before the movie. In such case, the provisions of the present article are corroborated with the provisions in point 22 of the General Terms and Conditions (GTC)..
34. In none of the up mentioned cases, Cinema City does not owe the Customer any damages including, but not limited to transportation costs, parking costs, costs for 3D glasses, food, drinks, etc. In order to take advantage of the rights hereunder, the Customer must provide Cinema City with a valid online purchased ticket for the screening that has been suspended or canceled within 2 days after the date of the canceled/suspended screening and fill in and undersign at the multiplex cinema the ticket is for, a form for replacement/revalidation of the ticket.
35. In the event of terminated, cancelled or replaced screening due to technical or other reasons not attributable to Cinema City, the rules specified in the General Terms and Conditions (GTC). shall be applicable.
LIABILITY
42. Cinema City does not exchange, reissue and refund amounts for stolen, lost or damaged online tickets.
43. Cinema City is neither responsible for the execution of payment transactions in connection with the online purchase of tickets by Customers and for the security of Customers’ payments on the Internet, nor for any damages (including losses and lost profits) of Customers in connection with or arising from online payment for tickets through the payment service provider PayU SA, Poland, as the services in connection with accepting and processing payments are delivered by payment service providers and providers of technical services other than the Company.
44. Without prejudice to the applicability of the mandatory provisions of law, the liability of Cinema City in connection with or arising out of the services offered by Company and/or its activities as a film exhibitor managing the multiplexes specified in Cinema City General Terms and Conditions (GTC)., shall be limited to willful misconduct and gross negligence, and in property terms – to the price paid by Customers for the respective services (e.g. price of the ticket purchased online, price of 3D glasses, etc.).
RECOMMENDATIONS, COMPLAINTS AND COMMENTS
45. The Customer can send a recommendation, comment or complaint regarding the process of purchasing electronic tickets via the Website by completing the contact form on the Company's Website under "Contact Us" section
MISCELLANEOUS
46. To all matters not explicitly governed by these Terms and Conditions for online sale and the General Terms and Conditions (GTC) and/or Romanian laws shall apply.
47. In case of disputes between Customers and Cinema City, the parties shall make all reasonable and necessary efforts to resolve the dispute in an amicable way through negotiations and mutual concessions. Failing to reach an agreement the dispute shall be resolved according to the Romanian Law.
GDPR
48. In connection with the online process of purchasing tickets via the Website, the Customer will provide the Company with the Customer's personal data. The controller of personal data is the Company. You can contact us, and our Data Protection Officer, in matters related to your personal data via:
• sending an e-mail to: [email protected] or
• post at: Cinema City SRL, Str.Dr. Alexandru Boicescu, nr. 10A, et. 2, biroul nr. 1, Sector 5, Bucuresti (note: Head of Marketing).
1. Even though providing personal data by the Customers is voluntary, it is necessary for the reasons indicated in point 3 below, in particular, purchasing cinema tickets on-line. As a result, without the Customers' personal data, we are unable to properly implement the objectives mentioned above.
2. Personal Data are processed for the purposes described in the Privacy Policy and includes:
a) processing in order for enabling and correct implementation of the ordered services/products or (legal basis for processing: Article 6 (1) letter b of Regulation of the European Parliament and of the Council 2016/679 of 27/04/2016 on the protection of individuals with regard to the processing of personal data and on the free the flow of such data and the repeal of Directive 95/46 / EC ("GDPR"), i.e.
b) consideration of any complaints, archiving or current contact related to the ordered service/product - based on our so-called legally legitimate interests, which are respectively: clarification of matters, defense or settlement of claims, the need for ongoing contact (basis: Article 6 paragraph 1 point f) of the GDPR),
c) improvement of our products and services, development of new products and services and marketing activities of own products and services (in the traditional form), which are our legitimate interests (basis : Article 6 paragraph 1 point f) of the GDPR),
d) with a separate consent – processing within in the scope covered by the given statement, for example, when agreeing for obtaining from us e-mails with promotions (basis: Article 6 paragraph 1 point a) of the GDPR).
e) enabling Cinema City to comply with its legal obligations regarding accountancy or solving civil/consumer dispute (basis: Article 6 (1)(c) of the GDPR with connection to specific provisions of elated law).
3. In case of ticket purchase by the Customer, his personal data shall be provided to the payment operator operating the online payment services, only for the purpose and to the extent necessary to enable payments to be made. The payment entity to which the data are made available shall be considered as a separate controller of those data. The Customer himself provides the payment operator with his payment details (such data are not stored by the Company). We would like to inform you that you have the right to access your data and correct them also with the payment operator.
4. Customers' personal data provided to the Company will not be disclosed to third parties, with the exception of the cases specified in detail in separate clauses of consent to the processing of personal data, provisions of the Terms and Conditions, cases of disclosure of data to employees or collaborators of the Company or entities providing support to the Company on the basis of concluded agreements to entrust data processing (in particular: IT support, IT system management, legal advisory services), or cases specified by law (such as, for example, sharing personal data contained in paper correspondence with postal operators or carriers to deliver correspondence, sharing personal data with state authorities),

The Company informs that requests for consent are addressed to persons with full legal capacity, who can make such a statement on their own behalf and persons with limited legal capacity who act with the consent of a parent or legal guardian and have obtained his consent to take actions to conclude a contract and make statements (including consents) in accordance with these Regulations and the Privacy Policy.
6. The Company ensures that personal data provided to the Company of the Website by Customers will be protected by technical means ensuring the highest level of security of Customers' personal data, in accordance with applicable regulations;
7. The Company informs that the Customer might have the opportunity to take advantage of currently available promotions organized by the Company. The details and conditions of the promotion will be described each time in separate regulations of promotions made available to Customers through the Website. Taking advantage of the promotion is possible on the terms and conditions specified in each case in the regulations of the promotion. The Company informs that personal data of the Customer using the promotion will be processed only for the purposes indicated in the regulations of the promotion, in particular in order to confirm that the conditions for participation in the promotion and its implementation have been met and to consider possible complaints. Providing data for this purpose is voluntary and the Customers participating in the promotion have the right to access the content of their data and correct them.
8. The Company informs that the data subject has the right to access and rectify, delete, restriction of processing, the right to data portability or object to the processing, the right to withdraw consent at any time without affecting the lawfulness of data processing prior to revocation. The data subject has the right to lodge a complaint with the data protection authority (Autoritatea Naţională de Supraveghere a Prelucrării Datelor cu Caracter Personal, B-dul G-ral. Gheorghe Magheru 28-30, Sector 1, cod postal 010336, Bucuresti, Romania), if he considers that the processing of his personal data violates the provisions of the GDPR.
9. The data will be processed until the realization of the purpose for which they were collected, and for archiving purposes - not longer than it is necessary until the expiry of the deadline for filing a claim for the service provided. If we process data with a consent, they will be stored until the consent is withdrawn.
The Company informs that the Customer may participate in currently available promotions, organized by the Company. The detailed terms and conditions of a promotion are specified in the terms and conditions of a promotion, which are provided to the Customer via the Website. Participation in a promotion is possible based on the conditions set forth each time in the terms and conditions of a promotion. The Company informs that the personal data of the Customer participating in a promotion shall be processed only for the purposes indicated in the terms and conditions of a promotion, especially in order to confirm the fact that the Customer is entitled to participate in the promotion and the development thereof, and in order to examine possible complaints. Personal data supply is voluntary, and the Customer is entitled to access the data thereof and to rectify them.
COMPLAINTS
49. The Customer may issue a complaint about the online ticket purchase process by the use of the Website within 7 (seven) calendar days of the purchase date. The complaint can be sent to the Company by e-mail to the address: [email protected]
50. Within the complaint, the Customer shall specify the scope of the complaint thereof, as well as the number of the transaction. The Company shall not be held liable for the incorrect purchase made by the Customer, especially for the supply of incorrect or untruthful data.
51. The complaint shall be examined and answered by the Company within 20 business days of the moment when the Company receives the complaint. The Company shall inform the Customer about the decision by e-mail, within the up mentioned term.
FINAL PROVISIONS
52. These Online Terms and Conditions are made available free of charge using the Website, allowing the download, registration and printing of it, and also at each multiplex cinema box office.
53. For the full set of the rules that apply to the relations between Cinema City and all of its Customers in connection with the film exhibition service and food serving services offered by the Company please consult the Cinema City General Terms and Conditions
