CINEMA CITY ROMANIA GENERAL TERMS AND CONDITIONS

1. CINEMA CITY ROMANIA. SRL is a limited liability company incorporated and registered pursuant to the laws of Romania, having its seat and registered address in Bucharest, Dr. Boicescu Alexandru Street, No. 10A, Office no. 1, 2nd Floor, 5th District, registered with Bucharest Trade Register under no. J40/16742/2006, with Tax Identification Code RO 19123195 (hereinafter referred to as „Cinema City” or the „Company”). 

2. Cinema City Romania manages 28 multiplexes in 21 cities: 
Cinema City Arad Atrium, Cinema City Bacău, Cinema City Buzau, Cinema City Baia Mare, , Cinema City Brașov, Cinema City Brăila, Cinema City Bucharest Cotroceni, Cinema City Mega Mall, Cinema City Bucharest Sun Plaza, Cinema City Bucharest Park Lake, Cinema City Deva, Cinema City Cluj Iulius, Cinema City Cluj VIVO!, Cinema City Constanța, Cinema City Constanta City Park, Cinema City Iaşi, Cinema City Piteşti, Cinema City Ploieşti Shopping City, Cinema City Ploieşti Afi, Cinema City Piatra Neamt, Cinema City Suceava, Cinema City Severin, Cinema City Târgu Mureș, Cinema City Targu Jiu, Cinema City Timişoara Iulius Mall, Cinema City Timisoara Shopping City.

EFFECT OF THE GENERAL TERMS AND CONDITIONS

3.  These General Terms and Conditions (the „GTCs” or “Terms and Conditions”) are general rules that govern the relations between Cinema City and all of its customers in connection with the film exhibition service and food serving and shall have effect in respect of all multiplexes operated by Cinema City. The current version of these GTCs is published at www.cinemacity.ro (the „Website”) and placed within all multiplexes at customers’ disposal, at the cashier’s desk. The Company reserves the right to change the GTCs from time to time, where the changes shall enter into force as of the publication of the changed GTCs on the Website and their placement within the multiplexes at customers’ disposal at the cashiers’ desk. Before buying a ticket for a screening or using any service offered by Cinema City, customers should check, review and get acquainted with these GTCs. The absence of such review may not be used as an excuse by customer, to claim against Cinema City due to lack of knowledge of the GTC’s.

4. By purchasing a ticket for a film screening the customer agrees to be bound by these GTCs. By General Terms and Conditions shall be understood and include also Terms and Conditions for online sales of tickets, Terms and Conditions for VIP, Terms and conditions for Gift vouchers, Terms and Conditions for 4DX cinema halls, Privacy Policy and GDPR.  

5. Please be aware that in case of online purchase of tickets, by checking the Accept button on the website the customer confirms that he has carefully read the GTCs, understood its content, accepts it and undertakes to purchase tickets in accordance with and in compliance with these rules.

6. By purchasing tickets at the cashiers’ desks, the customer confirms that he has carefully read the GTCs available at the cashier’s desk, understood its content, accepts it and undertakes to purchase tickets in accordance with and in compliance with these rules.

7. The sale of tickets (and if applicable, 3D glasses and/or food and drinks) is subject to availability. Cinema City does not oblige and shall not be responsible in case tickets (and if applicable, 3D glasses and/or food and drinks) are not available for a specific screening. 

8. It is  the customer’s responsibility to check that the details on the purchased tickets are correct and fit the requested screening (location, date and time of the desired movie) as Cinema City is under no obligation to rectify mistakes of the customers after the ticket has been purchased. Unless otherwise expressly stated herein, tickets cannot be exchanged or refunded.

9.  Cinema City is not responsible for the information displayed in its locations by third parties. Although Cinema City is always trying to provide accurate and up-to-date information, it does not take any responsibility for this information.

10. Trademarks and logos displayed on the website and in / on cinemas are owned by Cinema City or third parties. Customer is not permitted to use these trademarks and logos without written consent from Cinema City or relevant third parties. Abusive use of these marks and signs is a copyright infringement and shall be sanctioned according the law.

TICKETS AND PRICES

11. The exhibition of films is a paid service of Cinema City and customers need to buy a ticket to use it, unless otherwise provided for in these GTCs.  The prices of the tickets at Cinema City Romania comprise VAT (5%), the Romanian Red Cross contribution (1%) and the Cinematographic Stamp Duty (2%).  All prices of the tickets are in Romanian lei/RON. The display prices are the end prices of tickets, inclusive of all taxes and duties except the ones for online tickets that are to be added with the Online Service fee for online purchase– to be detailed in the online purchase Terms & Conditions.

12. The customer represents and warrants that any tickets or 3D glasses purchased are for personal use only, and that they are not purchased as part of any form of business or commercial activity to be resold. The tickets or 3D glasses may not be sold/resold by the customer except the cases the Company expressly agreed to. Same with vouchers, food, drinks and / or other form of passcodes issued by Cinema City Romania part of their services at the disposal of the customers.

13. Access to the cinema halls will be allowed by Cinema City exclusively on the basis of:
- tickets bought at the ticket offices in the multiplex cinemas;
- the iQR codes on the electronic tickets attached to the confirmation e-mail received for the online purchase through the "Electronic ticket" option and presented on the phone or other electronic device;
- printed electronic tickets, issued at the time of online purchase through the "Electronic ticket" option.

14. The price of tickets may vary in different multiplexes operated by the Company and/or between different screened movies. Current ticket prices are listed on the Website, in the “Summary & Prices” section of each multiplex and displayed prominently at the cash desks of each multiplex. All prices are inclusive of value added tax. The price of tickets may be changed by the Company at any time provided the new prices are listed on the Website, in the “Summary & Prices” section of each multiplex and displayed prominently at the cashiers’ desks of each multiplex at the disposal of the customers. 

15. Following the issuance of a ticket, no corrections or replacement with ticket for another screening or for another film, nor refund of its price marked on the ticket, is allowed, unless otherwise provided for in these GTCs. In this respect we ask the customers to be diligent when purchasing tickets and consider in advance the film, day and time of screening, and seats in the cinema hall which they are willing to use, and number and type of tickets which they are willing to buy. After you make your choice of film, screening time, number and type of tickets, seats at the cashier’s desk, you are entitled to ask the cashiers to check whether your choice is properly recorded by turning to you the screen with details of your order. In case of any objections, point them out immediately to the cashiers to be corrected, as following the issuance of tickets the same may not be corrected, replaced or returned anymore. In case of online purchase of tickets, after you make your choice of film, screening, number and type of tickets and seats you are strongly adviced to double check whether your choice is properly recorded, as following the issuance of tickets the same may not be corrected, replaced or returned. In case of online purchase of tickets we encourage you to carefully type your personal data necessary for the realization of this purchase, in particular e-mail address, and double-check if the personal data is correct. You can provide us with your own personal data, which is accurate and up-to-date.

16. Each ticket entitles its holder to one visit and only for the screening marked on the ticket, on the date and within the hours specified thereon, and in the cinema hall designated by Cinema City for that screening. The duration of the customer’s visit in the cinema hall is limited by the duration of the screening. Immediately following the end of the screening the customer is obliged to leave the cinema hall even if the customer has a ticket for the immediately following screening in the same cinema hall. In such cases the customer must leave the cinema hall after the first movie and shall follow the procedure for entering the cinema hall for the screening of the second movie.

17. For the removal of doubt, the price of the ticket includes the right to view a specific screening and does not include any additional service / product or any other item or equipment (unless specifically mentioned in these Terms and Conditions). 

18. Customers are required to keep their purchased tickets until the end of the respective screening and their exit of the multiplex. Cinema City is not responsible for lost, stolen, destroyed or damaged tickets and is not obliged to reissue tickets or refund the price paid for them or to provide any kind of different compensation. No claim for such service will be accepted, no matter the circumstances of lost, stolen, destroyed, or damaged ticket.

19. Customers have the right to cancel the purchased ticket exclusively and only at the cashier’s desk in the multiplex cinema the ticket is for, but not later than 30 minutes before the start time of the screening it has been issued for. In order to take advantage of their rights under this paragraph, the Customers must provide the Cinema City with a valid purchased ticket for the screening and fiscal receipt at the multiplex cinema the ticket is for.

20. Cinema City employees may refuse access to the cinema halls and screenings to persons without valid tickets for the respective screening or for different location as well as to persons who present damaged, torn, unreadable tickets or tickets manipulated in any way or falsified. In case of refractory customers, the Company may call for help from the cinema’s guardians and/or the police.

21. Customers should take their seats in the cinema hall before the start of the respective screening, but not earlier than 30 minutes before the start of the respective screening. Regardless of the possession of a ticket for a screening, if the customer arrives later than 30 minutes after the start of the screening the customer may be denied access to the screening without Cinema City having to refund the price paid for the ticket or pay any compensation. In case of refractory customers, the Company may call for help from the cinema’s guardians and/or the police to stop the client entering the hall. At the solely discretion of the manager of the multiplex the late customer may be (but not obligatory)  granted access to the screening at suitable time determined solely by the manager so that the other customers are not disturbed or their disturbance is minimized. In such cases, the manager, at its solely discretion can change the seats in the tickets and give the customer the seat/s that less disturb the other customers in the cinema hall. In case the customer refuses Cinema City is having no obligation to refund the price paid for the ticket or pay any compensation. By start of the screening is to be understood the hour mentioned on the ticket. 

22.  In the event of terminated, cancelled or replaced screening due to technical or any other reasons attributable exclusively to Cinema City, at the choice of the customer and to the extent that the provisions of this Regulation are met:
•    the customer will be granted another ticket/voucher for the same film on a different date;
           or
•    the current ticket will be replaced with voucher for another screening date of the same or another similar film according to the screening schedule of the respective multiplex. In case the customer choose to use the provided voucher for another film, the new film has to be the same category and ticket price with the film that was lost and the customer cannot pretend an upgrade in the film (from 2D film to 3D or higher, from 3D to 4D or hire, etc)

23. In this event Cinema City shall not pay to the customer any other compensation or damages than the movie ticket. Transportation costs, parking fees, costs for food and drinks and so on will not be covered by Cinema City in such cases. To benefit from their rights hereunder customers should present themselves to the Cinema City location where the ticket was bought for (same location) or send a request via e-mail or via the contact form available on the Website, present a valid original ticket from the screening which was terminated, cancelled or rescheduled not later than 7 days as of the day of the cancelled, terminated or rescheduled screening and submit the Protocol presented by the cashier. The Customer is obliged to collect the voucher/movie ticket within a maximum of 30 days from the date they have been informed by Cinema City via email, message or through the communication channel agreed by the parties, according to Cinema City's instructions.

24. In the event of terminated, cancelled or replaced screening due to technical or other reasons (such as power cuts, fire, forced evacuation from the location, fake fire or other kind of alarms requiring evacuation, safety exercises by the authority, accidents of any kind and any\ other incidents that stop the screening) not attributable to and not depending on Cinema City, Cinema City may decide upon its sole discretion the outcome of the terminated or cancelled screening. In this regard, customers should contact Cinema City via e-mail, the contact form in www.cinemacity.ro or directly on spot in the respective cinema where the event took place at, no later than 7 days from the date the screening was terminated / cancelled and follow the instructions given to them by Cinema City. Cinema City shall not be liable for refund of a ticket of a cancelled or terminated screening that is not attributable to Cinema City’s responsibility.  In the event of interruptions in movie screening due to any of the above reasons, in case the movie screening is resumed in a short period after interruption and the screening can continue after the incident, the customers are not entitled to any refund/change of ticket or any other compensation whatsoever. However, Cinema City may decide to ofer the Customer a voucher/ticket for a future screening. The Client is obliged to collect the voucher/movie ticket within a maximum of 30 days from the date on which they have been informed by Cinema City via email, message or through the communication channel agreed by the parties, according to Cinema City's instructions

25. While every effort will be made by Cinema City to fulfil the screening, in the event of terminated, cancelled or replaced screening due to decision of the authorities, calamities, r Force Majeure/fortuitous case or any other cases proven not in the power and responsibility of Cinema City, the screening will be deemed as completed and Cinema City shall not be liable for refund of a ticket of a cancelled or terminated screening. 

26. In this article Force Majeure shall mean any event or occurrence of an event that could not be anticipated by Cinema City in advance that caused the screening to be terminated or cancelled (such as war, strikes, riots, lock-outs or other labor disturbances, fire, flood, restrictions of the use of transport, fuel or power, requisitioning, shortage of material or transport or labor, restrictions imposed by the authorities or by the owner of the space, or any other cause beyond the control of Cinema City).  In the case of extreme bad weather conditions, Cinema City reserves the right to cancel the screening and offer an alternative date of film screening. In such case, no refund is due.

27. In the above-mentioned cases, at the choice of the customer:
•    the customer will be granted another ticket/voucher to the same film or the current ticket will be exchanged - if still on screening
           or
•    the customer will be granted another ticket for another film according to the screening schedule of the respective multiplex. In case the customer chooses to validate for another film, the new film has to be the same category and ticket price with the film that was lost and the customer cannot pretend an upgrade in the film (from 2D film to 3D or higher, from 3D to 4D or hire, etc).

28. The purchase of a ticket entitles the customer to visit the cinema hall designated by Cinema City once, for the respective screening within the duration of the screening and to watch the film to which the ticket refers while using the seat marked on the ticket only and if the customer meets all requirements set out in these GTCs and/or the law. 

29. If, after the purchase of a ticket, the customer refuses to visit the screening, give up the screening or does not use its seat in the cinema hall or does not watch the film or leaves the screening before the end of the film, Cinema City shall not refund the ticket price nor shall pay any compensation to customer.  

30. In case the customer has any claim whatsoever related to the quality of the screening, the seat and / or the conditions in the cinema hall, the customer must immediate announce the Cinema manager about such problems. The claims related to the up mentioned problems done at any time after the middle of the screening or after screening ends will not be taken into consideration by the Company and no compensation shall be granted. In case the clientt’s claim is found true, the provisions of article 22 shall become applicable.

31. Cinema City Romania is registered under the Value Added Tax Act. As the issue of an invoice is not obligatory, as per the law, in case the Customer wish to receive such an invoice, he must contact the Company at the contacts listed in these rules.

32.  Cinema City is entitled at any time to issue Gift vouchers for cinema tickets at its own discretion under the conditions described in “Terms and conditions for Gift vouchers”.  For more details, please check the respective regulations. 

ONLINE SALES OF TICKETS 

33.  Cinema City offers to its customers the possibility for online purchase of tickets through the Company’s Website, www.cinemacity.ro. For clarity, Cinema City does not offer the option to book tickets online, only to purchase them.

34.  The rules and conditions for online sales are governed by the Terms and Conditions for online sales of tickets ( OTC ) available on the Company's website.
 

FREE TICKETS

35.  The rules and conditions for online sales are governed by the Terms and Conditions for online sales of tickets ( OTC ) available on the Company's website.

Please note that persons with permanent disabilities and their attendants may benefit from free tickets up to a maximum of 10 tickets per month/multiplex, on presentation of a valid disability certificate at the time of admission and an identity card. The attendant will only be entitled to a free ticket under the above conditions if the disabled person is entitled to a professional attendant because of their condition.
Tickets are available for 2D and 3D films, including IMAX, but excluding VIP rooms and 4DX format. They can only be purchased at the cinema box office for screenings on the day of purchase and cannot be reserved or used for a later date. 

Free tickets will be allocated on a first-come, first-served basis, subject to availability at the time of request, until they have been allocated. Please check with the box office for the number of free tickets that are available.
Once the free tickets are allocated, the customer will be entitled to a reduced price for the disabled category. 

DISCOUNTS

36. Cinema City sets a standard ticket price for screenings, which is subject to discounts for certain categories of customers and under certain conditions, as follows:

  • Discount for Persons with Permanent Disabilities and their Attendants 

The discount is granted to all persons with a permanent disability upon presentation of a valid document certifying this status. The discount is also granted to attendants of persons with disabilities who present supporting documents that can prove such status.The discount for permanently disabled persons is granted after the monthly free tickets offered have been allocated, in both cases upon presentation of the document entitling to the discount.
The discount for the disabled cannot be cumulated with other discounts offered by Cinema City

  • Children discount

“Child” is considered the person having the age of maximum 10 years on the ticket purchase date (all infants from 0 to 10 years old); The parent / legal guardian of the child is obliged to have a document indicating the age of the child and present it to the cinema staff at their request. The document is to be presented to the Cinema City staff solely for the purpose of verification the entitlement for the discount. Cinema City does not withhold, record, copy or store in any other form the presented documents.

  • Pupils discount

“Pupils” are considered the young people between 11 and 19 years old. The parent/ legal guardian of the young person or the person over 18 is obliged to have a document indicating the age and present it to the cinema staff at their request. The document is to be presented to the Cinema City staff solely for the purpose of verification the entitlement for the discount. Cinema City does not withhold, record, copy or store in any other form the presented documents.

  • Student discount

“Students” are considered the young people attending an academic education form, full-time, evening classes and part –time and having the visas on the student card applied to date. The discount applies only upon presenting of a valid document that can prove the right of the person to receive the respective deduction of price.

  • Pensioners discount 

The discount applies to all pensioners upon presentation of a valid proof of the pensioner capacity of the person.

  • Discount for persons with permanent disabilities

The discount applies to all persons with permanent disabilities by presentation of a valid document proving such status. 

For the people with disabilities, the Company provides 10 free of charge tickets per month/cinema. The principal of distribution is done based on “First Come-First Served”.
After the run-out of the free of charge seats, the customer shall benefit from a discounted price afferent to the disable category, the presentation of the document conferring the right to discount being necessary in both situations.

We inform you that disabled persons and their attendants benefit from a free* ticket, based on the certificate issued by the Home Territorial Administrative Unit and the Identity Card. The attendant will benefit of free ticket under the conditions specified above only is the disable parson has the right to a professional attendant due to its condition. Please contact the cinema cashier to receive information about the number of free tickets remaining available.

*Free tickets to people with disabilities and their attendants are up to 10 per month/cinema for 2D and 3D movies, including IMAX. After the 10 free tickets per month/cinema will be finished, discount tickets for “disabled persons” will be given. The offer does not include VIP and 4DX halls.

  • Discount for teachers accompanying school groups

For each school group consisting of at least 10 pupils/children, one teacher who accompanies and supervises the group is entitled to a ticket at the price of 0.00 RON, upon verification of his/her capacity

  • CINEMARTI discount

Every Tuesday, customers receive a special discount of the list price for 2D and 3D movies. The new CINEMARTI discount prices can be found in the promotion details on https://www.cinemacity.ro/static/en/ro/cinemarti. 3D glasses are not included. Please note that the discount does not apply to special movie formats: 4DX, IMAX and VIP, nor for avanpremieres. Also, if Tuesday is a legal / national holiday, the discount does not apply. The price of tickets on Tuesdays that are legal or national holiday, is the weekend price tickets.

  • Discount Family Package for animated movies

For watching a 2D or 3D format dubbed animated movie classified with general audiente, in the family, the adults in the family pay the ticket at children discount price. The discount is permanent, for each day of the week, for dubbed animated movie. 3D glasses are not included. Details of the discount can be found on https://www.cinemacity.ro/static/en/ro/bilet-de-familie. By child is meant any person aged 0-10 years.
Please note that the discount does not apply to special movie formats: 4DX, IMAX and VIP, nor for avanpremieres.

Family Packages are for 2, 3 or 4 people as follows:

-   Family 2: The package contains 2 tickets: 1 child + 1 adult;

-   Family 3: The package contains 3 tickets: min. 1 child + max. 2 adults;

-   Family 4: The package contains 4 tickets: min. 1 child + max. 2 adults;

Tickets from the Family Package are purchased as a package and cannot be canceled individually. If a single ticket is to be canceled, the cancellation will be made in compliance with the cancellation conditions of the company and entails the cancellation of the entire package.

DISCOUNTS

37. The persons willing to buy discounted tickets shall have to prove their right to the respective discount (e.g. by proving their age, their capacity of a student, high-school student or pensioner etc.) by one or more up-to-date documents issued in Romania or issued abroad but accompanied by an official translation in Romanian language (if not in Romanian) made by a certified translator. To avoid abuses, upon presentation of documents for review by the employees of Cinema City, at least one of the documents must bear a photograph of the person willing to use the discount. For children discount category a document with picture is not required.  The documents mentioned in items 35, 36 and 37 are to be presented to the Cinema City staff solely for the purpose of verification the entitlement for the discount. Cinema City does not withhold, record, copy or store in any other form the presented documents. The documents under this item 35, 36 and 37 may be checked by the employees of Cinema City not only before the purchase of tickets, but also during the inspection of tickets by the ushers or before admission of customers to the cinema hall.  The present clause is applicable also in case the customer purchases the tickets online, 

38. In case a person who is willing to use a discount on the ticket price fails to certify his/her right to a discount, the sale of a discounted ticket shall be denied. In case the customer has have already bought the discounted ticket he/she shall be denied access to the screening unless he/she pays the difference to the price of a ticket without concession. The person to whom a sale of a discounted ticket is denied, may still enter the screening if he/she buys a regular ticket for the said screening without discount. 

39. The person who has bought a discounted ticket may not exchange or grant the ticket to another person unless that other person meets the requirements to receive a discounted ticket of the same type. If, however, such transfer has been carried out the person acquiring discounted ticket without being entitled to purchase such shall not be granted access to the screening unless he/she pays the difference to the price of a ticket without concession according to Cinema City discretion. In such cases, where the client refuses the payment of a ticket  Cinema City shall not bear any responsibility and will not own any compensation nor refund to the client.  

40. The persons entitled to use a discount from the regular ticket price should be aware that there may be screenings to which such a discounted price may not apply ( pre-premieres, premieres, special screenings, others, according to the Company’s  price politics) -For such projections the persons will not be able to benefit from any discount. The clients have to check in advance, either on the website of the Company or at the cashiers’ desks whether there is a discount applied in the ticket price for the screening they wish to attend.

41.  The prices of tickets for pre-premieres and premieres may be higher than the regular tickets price. In case of pre-premieres, premieres, special screenings, other special events to be announced by the Company, the discounts mentioned in art. 35 and art. 36 are not applicable.

42. Accumulation or sharing of discounts is not possible. If a person meets simultaneously several conditions for discount (e.g. the customer is both a pensioner and a disabled person), such person is entitled to one discount only, depending on the category to which he/she wishes to be classified (in the above example the customer is entitled to buy either a discounted ticket for a pensioner or a discounted ticket for a disabled person). A discounted ticket is available to only one ticket for the person that is entitled to receive said discount irrespectively from the number of tickets it purchases at once. 

3D SERVICES AND SPECIAL EFFECTS MOVIES (4DX)

43. The price of the 3D Service includes the price of the ticket for the screening as well as the Master Image 3D glasses. If the Customers already possess their own Master Image 3D glasses, they may choose to buy only the ticket for the screening. Cinema City informs the Customers, that it is impossible to properly watch a 3D designated movie without the proper Master Image 3D glasses.

44. In case of the movies using the Master Image 3D technology, by payment of the price for the 3D Services  the Master Image 3D glasses shall become the property of their purchaser. The glasses are reusable. Cinema City does not give any warranties or any other representation as to the ability of the customers to watch 3D films with 3D glasses not purchased from Cinema City or the quality of the performance.  If the customer decides to see the movie with 3D glasses that are not purchased from Cinema City, the quality of the visual will be entirely on his own responsibility and the Company does not own him any refund nor compensation and it does not bear any responsibility on the quality of 3D  that the customer perceive.  Cinema City 3D glasses can be used more than once but the Company can take no responsibility on an exact number of times the 3D glasses can be used.

45. In case of the movies using the IMAX 3D technology, the purchase of the 3D Service coveres the ticket and the irrespective 3D glasses. If the Customers holds their own IMAX 3D glasses, they can buy only the ticket for the screening. Cinema City informs that the proper reception of the movie without the proper IMAX 3D glasses is impossible.

46. 3D glasses purchased in the cinema will be collected from the cashier, together with the ticket. 3D glasses purchased online will be collected immediately before the screening from the entrance to the movie hall, based on the ticket printout. Customer’s failure to collect the glass does not entitle the Customer to a price reduction, refund or any other kind of compensation. The collection of the 3D glasses is responsibility of the Customer and the Customer alone. Loss or deterioration of the glasses before screening does not entitle the Customer to a price reduction, refund or any other kind of compensation.

47. The Company do not bear any responsibility for the quality of the 3D Service if the customer decides to see the movie with his own 3D glasses, which were not purchased from Cinema City or even from Cinema City but were not maintained well, which might cause scratches or anything else, which will affect the quality of the provided service.

48.  In case of the movies using the 4DX technology, before acquiring tickets for movies in 4DX format, please familiarize yourself with the rules made available for such screenings. You can find the Regulations for 4DX Movies on the website www.cinemacity.ro and at the cashiers’ desks on each cinema, at your disposal.

FILMS AND SCREENINGS 

49. All the movies running in the Company’s cinema halls are classified by the Romanian National Center of Cinematography (the “CNC”) in terms of the age segment to which they are intended. Clients are responsible for carefully checking the classification of the film before purchasing the tickets. The audience of the film must correspond to the age of the viewer. Nevertheless, the responsibility for compliance with these classifications by the audience exclusively devolves upon the ticket buyers

I.    AG – general audience

o    Movies accessible to all categories of audiences that:
a)    by the subjects addressed and the level of intellectual development involved, they can be watched and understood by people of any age group;
b)    by their content does not affect the physical, mental or moral development of the minors;
c)    falls within the standards of decency accepted by the majority of the Romanian public;
d)    do not contain one or more of the following elements:
1.    scenes of violence except the minimal character ones and ones that are integrated in a comic context, harmless to the psychological development of the audience;
2.    vulgar language or expressions;
3.    sexual nudity or sexual behaviors;
4.    scenes that present dangerous or harmful behaviors, which can be easily imitated by children;
5.    scenes depicting the use of alcohol, drugs or tobacco;
6.    scenes depicting the use of knives and firearms, except those in a comic context and which are harmless to the viewer's mental development.
e)    does not fall into the classification categories of points II. – VI.

II.    AP-12 – parental approval for children under the age of 12

o    Movies that can be watched by children up to 12 years only with the parents’ consent or together with parents or family and containing one or more of the following elements:
a)    subjects or themes which, by virtue of the area of interest they represent and the level of intellectual development involved, are aimed at a viewing public of up to 12 years of age; 
b)   mental and physical violence of minimal duration and intensity, in a realistic context or likely to be perceived as such, including in animated films, comedies, parodies or films with fantasy and S.F. themes;
c)    language vulgarity, obscene gestures of minimal duration and intensity;
d)    nudity unaccompanied by sexual behaviour;
e)    scenes in which white weapons or firearms is minimal;
f)    scenes depicting the use of alcohol and tobacco;
g)    scenes of family discord accompanied by verbal violence;
h)    does not fall into the classification categories from points III. – VI.

III.    N-15 – not suitable for children under the age of 15

o   An adult must be present at the time of ticket purchase and give consent for children under 15 to view the N-15 rated film as the movie contains one or more of the following:
a)    subjects or themes which, by nature of the area of interest they represent and by the level of intellectual development involved, are not intended for audiences under 15 years of age; 
b)    scenes of physical and psychological violence of average intensity and duration (not exceeding 50% from the film duration);
c)    scenes with sexual behaviors and nondetailed rape scenes;
d)    vulgarities of language, obscene gesture of medium duration or intensity;
e)    scenes of alcohol, tobacco or drug use, without advocating their use, which do not explicitly encourage the imitation of such behaviour;
f)    scenes with antisocial behaviors and attitudes that can be imitated with ease;
g)    scenes with use of white weapons or fire arms;
h)    scenes of cruelty to humans or animals of average intensity and duration;
i)    does not fall into the classification categories of points IV. – VI.

IV.    IM-18 – Films not suitable for minors; 

o   Admission is not permitted under the age of 18, even accompanied by a parent/tutor as the movie might be horror, erotic, thriller, etc, which contains one or more of the following elements:
a)    scenes of repeated physical and mental violence, exceeding 50% from the film duration;
b)    scenes showing explicit sexual acts, rape scenes;
c)    vulgar language, obscene gestures of high intensity and duration;
d)    scenes that explicit encourage sadistic pleasures or drug use;
e)    scenes with cruelty or sadism content of high intensity and duration;
f)    scenes detailing the criminal techniques;
g)    scenes offering details on suicidal acts and techniques;
h)    does not fall into the classification categories of points V. - VI.

V.    IM-18 XXX – movies forbidden for people under the age of 18 and public screening.

o    Movies that contain:
a)    scenes with excessive content of cruelty or sadism;
b)    pornographic films;
c)    does not fall into the classification category in point VI.

VI.    IC – Movies with a ban on communication

o    This category includes:
a)    films that through their content incite violence, hatred, discrimination and intolerance or that promotes and glorifies any behavior discriminatory on grounds of ethnic origin, nationality, race, sex and sexual preferences, color, language, religion or religious affiliation, political or other opinion, social origin, affiliation or association with a national minority, property, birth or which violates fundamental human rights;
b)    films whose main purpose is to make pejorative references or discriminatory on the basis of ethnic origin, nationality, race, religion or disability of minors;
c)    films which depict in detail the means and methods of suicide;
d)    pornographic films with minors involved in any form explicit sexual behavior;
e)    films in which adult actors play the roles of minors with an explicit sexual behavior or images that, although they do not present real characters, credibly simulate explicit sexual behaviors of minors;
f)    films with zoophilic or negrophilic character.

50. Cinema City does not bear any responsibility for the film categorization. Each adult customer shall decide on its own and for his/her children in case such decision is allowed whether to watch a certain movie taking into account the special rules for access to film exhibition of persons under the age of 18Y.

51. Customers’ access to screenings is carried out by Cinema City in accordance with the films categorization and the resulting limitations. If a customer has purchased a ticket for a screening to which the customer has no right of access because of the film categorization by CNC and the age of the customer, and such access is denied, Cinema City shall not refund to customer the price of the ticket, neither shall replace the ticket for another screening nor shall pay any compensation to the customer. At the moment of ticket purchase, the responsibility for the compliance with these classifications by the audience exclusively devolves upon the customer buying the ticket.

52. Cinema City may check the age of customers willing to attend/entering a screening in order to verify whether the age requirements resulting from the categorization of films by CNC are fulfilled. The check may be performed not only before the sale of the ticket, if possible, but also during the ticket inspection and the access of the customer to the cinema hall. Cinema City may deny access to a screening of a customer whose age does not meet the requirements resulting from the film categorization. The check of customers’ age is carried out in accordance with the rules set out in ‘Security and Checks’ section of these GTCs.

53. Cinema City is not responsible and makes no warranties as to the contents of films, their artistic value, whether they belong to a certain genre or whether they are suitable for children, pregnant women, elder people, and people with heart or other diseases. Some films use bright, flashing lights, visual patterns and / or imagery which may cause discomfort and /or seizures to those with photosensitive epilepsy. The customers are obliged to check before the screening and to make sure the screening fits them and those who accompany them and makes no harm to their health condition.

54. Cinema City will make all reasonable efforts to ensure that the announced screening schedule of films is respected. Cinema City shall take no responsibility whatsoever in the event of changes in the screening schedule, if there are not any customers who have purchased tickets for the changed or cancelled screenings. The relations between Cinema City and customers who have purchased tickets for cancelled or changed screenings shall be governed by the rules set out in Article 22 above. Changes in already announced screening schedules shall be announced on the Website  of Cinema  City where the movie schedule is published and in the multiplexes, where the customers shall check themselves for such changes.

55. At the beginning of the screening, for a duration of up to 25 minutes, Cinema City has the right to broadcast trailers and commercial spots before the film. Therefore, the scheduled start time of the screening refers to the beginning of the broadcast trailers and commercial spots and not beginning of the movie

56. Pregnant women and people accompanied by children under 5 years of age have priority at the box offices, as well as at all other services offered by Cinema City

ACCESS OF PEOPLE UNDER 18Y OF AGE

57. The access of people under 18Y to the Cinema City multiplexes is to be made in line with the age limits set by the CNC film classification and shall be governed by the following rules:

  • During screenings marked ‘AG’ category – „General audience” all customers regardless of their age will be allowed to access the cinema hall;
  • During screenings marked ‘AP-12’ category – „parental approval for children under the age of 12” clients under the age of 12 are only allowed in the cinema hall with the consent of/or in the company of a parent/tutor; 
  • During screenings marked ‘N-15’ category – „Not recommended for children under 15Y” an adult must be present at the time of ticket purchase and give consent for children under 15 to view the N-15 rated film.
  • During screenings marked ‘IM-18’ category – „Forbidden for persons under 18Y” persons under the age of 18 will not be granted with access to the cinema hall, even accompanied by a parent/tutor.
  • Screening marked ‘IM-18 XXX’ category – the movies forbidden for people under the age of 18 and public screening are not screened in the Cinema City halls for public.
  • Screening marked ‘IC’ are not allowed for screening or communication and are not screened in the Cinema City halls.

58. Cinema City has the right to deny access to a screening of each customer who must be accompanied, but the companion is missing or does not meet the criteria set out in the present T & C irrespective of whether such persons have purchased tickets for the screening they are willing to attend. 

59.  In case Cinema City denies access pursuant to the preceding sentence, Cinema City shall not reimburse the persons to which access is denied for the ticket price paid by them neither shall pay any other compensation. Verification of the age of persons shall be carried out in accordance with the rules set out in the ‘Security and Checks’ section of these GTCs.

60. For the convenience of our customers and their children we do not recommend the Cinema City multiplexes to be visited by children under 3Y of age or older but with health conditions. Parents should be aware that conditions in cinema halls may not be suitable for their children – during screenings the lights are off, the sound is loud, flash lights present and some of the films have special sound or visual effects that may startle or disturb the children and/or create psychological or other mental or physical problems. If you insist on visiting a screening together with your child, please be aware that Cinema City shall bear no responsibility and pay no compensation on any harm that your child might suffer due to the presence in the cinema hall against our recommendations.

61. In case the underage child present in the movie hall is disturbed by the noises/flash lights/atmosphere in the cinema hall and the customer decides to leave the cinema hall before the movie ends, the customer is not entitled to refund of the ticket price or any other compensation. If the child is noisy or disturbs by behavior the other viewers of the screening you and/or the child might be asked to leave immediately the cinema hall which case, you are not entitled to refund of the ticket price or any other compensation.

62. Each person aged from 0+ months to 18Y attending a screening in the Cinema City multiplexes should buy a ticket irrespective of whether such person use a seat in the cinema hall to watch the film or sit on the parent/companion’s chair. The persons aged up to 18Y can benefit from a discount in the regular ticket price according to the ‘Discounts’ section of these GTCs.

ACCESS OF ANIMALS

63. Animals, regardless of their type and status, shall not be granted access to the Cinema City multiplexes. Exceptions are allowed only for guide dogs of persons with disabilities. To be allowed in the cinema hall, the guide dog must be led on a short non-stretchable strap and its veterinary passport and a guide dog certificate must be presented for inspection to the employees of Cinema City.  A ticket for the guide dog is not required.

RULES OF CONDUCT

64. In the cinema halls the customers will have access only with nachos, popcorn or other alcoholic beverages available in our offer in the café or buffet inside the cinema multiplex. 

65. In the Cinema City multiplexes it is not allowed:
•   to carry and consume food or alcoholic beverages bought outside the relevant cinema multiplex; 
•   to use the tables, which are located at cafe’s located inside Cinema City multiplexes, by any other persons than the customers who are consuming products purchased from either the café itself or the concession, which is also located inside cinema. People without consumption are not allowed to use the table even if they possess tickets for any of the movies screened in the cinema;
•    consumption of food bought outside the relevant cinema multiplex is forbidden despite that the clients might have bought products from our café or buffet and have tickets for the cinema;
•    to smoke in any form and by any means, including but not limited to tobacco pipes, electronic cigarettes and anything similar in any place inside the cinema multiplex;
•    purchase and /or consumption in the cinema of alcoholic beverages by persons under 18Y;
•    the possession and use in the cinema multiplex of weapons, ammunition, explosives, pyrotechnic articles, other dangerous devices, narcotics, illegal substances and any other substances whose usage is prohibited and/or dangerous to life and health of people;
•    talking and any other activities within the cinema halls which disturb or may disturb the other customers during screenings (kicking and pushing seats, rustling, talking on mobile phones, playing of video or sound recordings, singing, running, climbing, jumping, etc.); 
•    the use of mobile phones in the cinema halls is forbidden as a courtesy to other viewers. All phones should be put on “Silence” mode throughout the screening; also, message texting is not allowed as the light from the phone might disturb the other customers watching the movie;
•    placement of feet (with shoes or not) on the seats/tables/other objects in the cinema;
•    running in the hallways, walkways, stairs or in the lobby;
•    due to security reasons – sitting on the stairs, floor or any other places inside the hall different than the seats written on the customer`s tickets;
•    leaving young children unattended;
•    letting young children to cause disturbance to other viewers;
•    disposal of waste not in the designated areas;
•    placement of personal belongings on seats for which no ticket is bought or between the rows of seats or on the aisles;
•    entry and stay in staff and technical offices;
•    entry and stay in the cinema multiplex of persons visibly intoxicated, agitated or in aggressive mood, as well as persons who may be presumed to be under the influence of illegal substances;
•    entry and stay in the cinema of persons with indecent clothing or unhygienic or untidy appearance; 
•    entry in the cinema with voluminous luggage;
•    entry and stay of persons who refuse to be checked;
•    causing any intentional damage of any kind to Cinema City and refuse to cover it,
•    a customer to let other people inside the hall through the exit doors or any other way if they are not allowed to attend the respective projection due to any of the reason mentioned in this GTC.

66. Persons who do not comply with the above rules of conduct will be asked to leave the multiplex irrespective of whether they have purchased a ticket and the screening haven’t started or if the screening is in progress.  If customers refuse to leave the multiplex voluntarily, they will be forced to leave the complex by the security guards of the complex or the police authorities the cinema staff will call in case the customer refuses to follow the rules and / or become turbulent. Cinema City shall not reimburse the customers who left or were forced to leave the cinema multiplex for the abovementioned reasons, the ticket price or the price of the other services used by them neither shall pay them a compensation of any kind.  In case the customer that was asked to leave the multiplex caused any damage of any kind to Cinema City, Cinema City may pursue compensation from the said customer.

PIRACY

67. The films screened in the Cinema City multiplexes are the result of the efforts of hundreds of people and are protected by copyright law. In order to protect their rights and their work, the use of video cameras and any other recording, filming or broadcasting devices during screenings in the movie halls is strictly forbidden. In case a customer is found filming/recording inside the cinema hall he/she will be asked to delete the filmed/recorded material and invited to leave the cinema hall. Cinema City shall not reimburse the customers who left or were forced to leave the cinema multiplex for the abovementioned reason, the ticket price or the price of the other services used by them neither shall pay them a compensation of any kind.  In case the customer that was asked to leave the multiplex caused any damage of any kind to Cinema City due to such acts, Cinema City may pursue compensation from the said customer.

68. Any recording, copying, reproduction, distribution, broadcasting or transmission of films and film materials without permission it is sanctioned by the law. In this regard, it is illegal to copy or film copyrighted material including but not exclusive to the main feature film, any previews and any music played within Cinema City multiplexes. Cinema City prohibits such actions on the territory of its multiplexes. The Company is warning its customers that any person violating the anti-piracy rules shall be immediately asked or forced to leave the cinema hall and no compensation shall be granted, as stipulated in art 66.
Customers will not be allowed to enter the cinema wearing “Google Glasses” (or any similar device) or any other wearable technology capable of recording images and /or sound. 

69. Cinema City asks its customers not to keep in secret any violations of the copyright and related rights and to report such violations to the cinema staff.

SECURITY AND CHECKS

70. Cinema City multiplexes are guarded areas. Security guards and technical devices for video surveillance are used to secure each location and/or protect persons present in the location. The area under video surveillance is marked with separate information for the customer (or guests) upon entering. The security guards of the multiplexes shall bear ID card with a photo, badge and a special uniform. The security guards of the Cinema City multiplexes are entitled to require compliance with the present GTCs and have the following duties:
•    checking the entrance tickets of all customers;
•    checking the identity documents of the customers benefiting of discounts and other relevant documents of the ones that need to prove their age to be allowed to enter to specific movies and the work passes of the employees of the Cinema City multiplexes; 
•    checking the approval of the parents /tutors for the persons needing such approval;
•    asking persons who don’t comply with the rules of conduct to leave;
•    stop the entrance to cinema / cinema halls of the persons under the conditions mentioned in art. 65; 
•    stop the person to leave the cinema areas in case of security incidents, before the arrival of the police;
•    call the police in case of security incidents of any kind;

71. The customers may prove the fulfillment of the conditions for access to the cinema halls and the conditions for purchase and use of discounted tickets by all appropriate and up-to-date documents issued in Romanian or foreign language accompanied by an official translation in Romanian made by a certified translator, such as ID card, passport, driving license, birth certificate, certified students card, school card, etc. These documents may be required for inspection by the cashiers, ushers, security guards or other employees of the multiplexes in specific cases described in the present GTC. If a person is not willing to present a document certifying his/her right to access the cinema hall or purchase discounted tickets, such person shall/might not be granted access, respectively discounted tickets. In case the customers already bough the ticket but refuses to present the ID Cinema City shall not reimburse the ticket price or the price of the other services used by them neither shall pay them a compensation of any kind. The documents mentioned in this items 70 are to be presented to the Cinema City staff solely for the purpose of confirming the right to access the cinema hall or purchase discounted tickets. Cinema City does not withhold, record, copy or store in any other form the presented documents.

72. The tickets and documents of the customers may be checked when they are purchasing tickets or thereafter, at the entry of the cinema hall mentioned on the ticket or during the stay therein, in case Cinema City employees or security guards suspect any violation of law or these GTCs by the customer or with the customer’s cooperation.

73. Neither Cinema City nor the security guards of the multiplexes shall bear any responsibility for lost or stolen tickets or personal belongings left unattended.  Cinema City will not be held responsible for any damage or loss of customer’ property howsoever caused.

LIABILITY

74. Without prejudice to the applicability of the mandatory provisions of law, the liability of Cinema City in connection to or arising out of the services offered by Company or its activities as a film exhibitor managing the multiplexes specified at the beginning of these GTCs, shall be limited to willful misconduct and gross negligence, and limited by the price paid by customers for the respective services (e.g. ticket price, price of 3D glasses, etc.). Cinema City shall bear no responsibility for any special, indirect or consequential losses incurred by the customers in any way. 

75. Cinema City will not be liable if for any reason its website is unavailable for any period. Access to the site may be suspended temporarily or permanently at any time and without notice. Cinema City makes no guarantee of any specific result from use of this site.  Cinema City shall be released from any and all liability for the acts, omissions and conduct of any third-party users  and /or hackers, if the case might be.

76 Cinema City shall bear no responsibility for any information displayed or broadcasted in any cinema operated by it by any third party or for the content of any film or advertisement that is shown at any cinema operated by it.

77. Cinema City shall bear no responsibility for the inappropriate conducts and/or behaviors of its customers against other customers and of the third parties breaking in the cinemas by violating the present GTC. 

MISCELLANEOUS

78. To all matters not explicitly governed hereunder the Romanian law shall apply.

79. Cinema City shall maintain in each of its multiplexes a register of complaints, praises and claims. Claims could be filed during working hours at the multiplexes, and/or the registered address of the Company and/or by email. In case of a problem or irregularity in the cinema, please contact the manager of the respective cinema, immediately. Late complains regarding an ongoing issue that can be checked outright shall not be taken into consideration.

80. The customer can submit a complaint regarding the irregularities in the cinema within a maximum 7 (seven) calendar days of the problem discovery, unless otherwise specified herein. The complaint can be sent also by e-mail to the address: [email protected]. In the content of the complaint, the customer must specify the object of the complaint and as many details as possible. 

81. The complaint will be examined and answered by the Company within 20 business days from the moment when the Company receives the complaint. The Company will inform the customer about the decision by e-mail and /or by courier paid by the customer, at the customer’s choice mentione in the complaint. 

82. Any claim can be took into consideration only by presenting the purchased ticket as an evidence that the client attended the respective event.

83. In case of a dispute between customers and Cinema City, the parties shall make all reasonable and necessary efforts to resolve the dispute in an amicable way through negotiations and mutual concessions. Failing to reach an agreement within one month as of the failure of the amicable negociations shall result to its submission to the competent Romanian court in the city of Bucharest.

84. The purchase of tickets for a movie or other special event / screening is considered a contract for provision of services of leisure activities, through which the Company undertakes to provide this service at a certain time or within a certain period and, as such, the Customer cannot withdraw from this contract pursuant to art. 16 lit. l) of the Government Emergency Ordinance no. 34/2014 on consumer rights in contracts concluded with traders, as well as for amending and supplementing some normative acts, with subsequent amendments. 

GDPR RULES

85. When you provide us with your personal data, you confirm that the information you provide to us that identifies you is accurate and complete and in the case of limited legal capacity, that you have the consent of a parent or legal guardian to provide us with this data or where you are acting on behalf of a minor (child) or a person without legal capacity – that you are authorized to provide us with this data. It is your responsibility to ensure that your personal data is up to date and Cinema City is not responsible for matters arising from errors or omissions in personal data. You may update your own personal data at any time contacting us at: [email protected]. Where our customer is aged under 18, their parent or legal guardian may also notify Cinema City of any changes or inaccuracies in their data. Below you will find general information on how we process your data.

86. The data controller of the personal data of the persons using the services/products offered by Cinema City is Cinema City Romania SRL is a company with its registered office in St. Alexandru Boicescu, no. 10A District 5, 050484. Contact with the data controller is possible via the e-mail mentioned in point 85 or in writing (by post using the abovementioned address or via the contact form: https://www.cinemacity.ro/contact). We have also appointed the Data Protection Officer, which can be contacted by e-mail:  [email protected] or by correspondence to our address. 

87. Please be advised that personal data is processed for the purposes described in our Privacy Policy and includes processing in order to:
(i)    enable and correct implementation of ordered services / products, in particular in order to: register your purchase and/or discount ticket, provide you with service e-mails related to purchase, verify the identity, or right to discount or age, settle payments for services - based on the need to conclude and implement a contract that is binding or taking steps before its conclusion at your request (basis: Article 6 (1) letter b of the Regulation of the European Parliament and of the Council 2016/679 of 27.04.2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repeal Directive 95/46 / EC (“GDPR”)
(ii)    consideration of any complaints, current contact related to the ordered services / product, archiving for the purposes of establishment, exercise or defence of legal claims, security of persons and property, including prevention against COVID-19 - based on our so-called legitimate interests, which are respectively: clarification of matters, the need for ongoing contact, defense or settlement or exercise of claims, the need for secure the area and persons (basis: Article 6 (1) letter f of the GDPR) 
(iii)    improvement of our products and services, development of new products and services and marketing activities of own products and services (in the traditional form) - based on our legitimate interests, which are mentioned in this section of activities including the pursuit of development and promotion of Cinema City services (basis: Article 6 (1) (f) of the GDPR)
(iv)    with a separate consent - for the purpose indicated in your separate statement (consent clause), which concerns the receipt of promotional (marketing) information only if you provide us with such freely given consent (basis: Article 6 (1) (a) of the GDPR)
(v)    and enable Cinema City to comply with its legal obligations, such as complying with law on film screening with age restrictions, accounting or book-keeping obligations (basis: Article 6 (1) (c) of the GDPR).

88. FINAL DISPOSALS

91.  Cinema City reserves the right to amend these Terms and Conditions from time to time without notice. Changes will come into effect once published and posted on the Company’s website and at the cashiers’ desks in each multiplex cinema. Please make sure, to check them regularly for any changes. Updated Terms and Conditions will have effect only for the future, from the moment of publication on the site and at the cashiers’ desks, not affecting the purchases of online tickets and the transactions already made under the rule of the old Terms and Conditions

92. The issues not regulated by the present Terms and Conditions shall be governed by the regulations of the Civil Code and of the Government Ordinance no. 21/1992 on consumer protection.

4 WHAT PERSONAL INFORMATION DO WE COLLECT AND HOW DO WE USE IT? 

We obtain your personal information from the following sources:
• Directly from you, either in person (at our cinemas or otherwise), via our Site, on our social media pages or when you contact us or someone contacts us on your behalf; 
• Automated technologies, such as CCTV or other recording systems, cookies, server logs and other similar technologies;

• Providers of social media platforms (such as Facebook, Twitter, Instagram) where you share our content through social media, by liking us on Facebook, following or tweeting about us on Twitter;

Our primary goal in collecting personal information about you is to: (i) verify your identity and age; (ii) provide our Services to you and carry out requests made by you on the Site or in our cinemas; (iii) help us improve our products and services and develop and market new products and services; (iv) investigate or settle inquiries or disputes; (v) comply with any applicable law, court order, other judicial process, or the requirements of a regulator; (vi) enforce our agreements with you; (vii) protect the rights, property or safety of us or third parties, including our other customers and users of the Site and at our cinemas; (viii) provide support for the provision of our Services; and (ix) use as otherwise required or permitted by law.  
In particular, we use your personal information for the following purposes:
 
4.1 1 Fulfilment of products and services  
We collect and maintain personal information that is voluntarily submitted to us during the use of the Site and/or our Services. We use the contact and payment details which are provided to us so that we can fulfil the supply of products and services which have been ordered from our Site or in our cinemas. We will use contact information to send you service related communications relating to these orders. This includes your purchase of products and services, registration for an account with us, your attendance at events hosted by us or our third party partners, hire of our cinemas for your own events and the processing of returns and refunds. For example:
 
  •  Gifts and other online purchases. 
If you wish to purchasetickets through our Site we will need to know your name, family name, email address and mobile phone number. We may also need this information when you make any other purchases via our Site. We use this information to process and fulfil your orders and to send you service related emails for your purchase.
     
If you wish to purchase from the Gifts section of our Sites we will need to know your name, payment card details and email address and where you ask us to send the gift to you by post, your delivery address.  Where you ask us to send the gift directly to the gift recipient, we will also need to know the name of the recipient and the delivery address for gifts sent by post or the name and email address of the recipient where gifts are sent by email.
 
If you choose to pay for your purchases on our website by credit or debit card      those payments will be processed by our payment providers rather than Cinema City. By clicking proceed to payment, you understand and agree that: (i) you will be leaving our Site and will be transferring to the payment provider’s site (ii) any personal data you enter on the payment provider site shall be subject to their own privacy policy.  We may also receive part of the payment details such as your name, email address and some of the digits of your payment card number from our payment processor.  These will be used to help connect your payment with your ticket on our Site and may also be used by us if we provide you with a refund.
 
What is our legal basis?

It is necessary for us to use your personal information to perform our obligations in accordance with any contract that we may have with you such as your contract with us for your purchase of your ticket. 
 
 

4.2 Customer Services 

Our Site and our cinemas use various user interfaces to allow you to request information about our products and services: these include printed and electronic enquiry forms, dedicated email addresses, our social media pages and enquiring with cinema staff in person or by telephone. Contact information may be requested in each case, together with details of other personal information that is relevant to your customer service enquiry. This information is used in order to enable us to respond to your requests.
 
What is our legal basis?
It is in our legitimate interest to use your personal information in such a way to ensure that we provide you the very best customer service we can.
 
4.3 Competitions, prize draws and other events and promotions  
From time to time, we may run prize draws, prize competitions and other promotions on our Site, on our social media accounts and/or in our cinemas. We may also run events at other locations. For the purposes of administering such promotions and events, we may process your name, contact details (including email address, postal address and/or telephone number), social media handle (if relevant) and any other personal information volunteered by you in your promotion entry. For certain competitions and events, we may process and publicise images, videos or sound recordings that you volunteer to us.
 
What is our legal basis? It is necessary for us to use your personal information to perform our obligations in accordance with any contract that we may have with you (e.g. the terms and conditions applicable to the promotion) or it is in our legitimate interest to use your personal information to enable you to participate in any prize draws, prize competitions and other promotions. We will only use photographs we take of you at events where we have your consent to do so.
4.4 Your feedback about our products and services. 
From time to time we will contact you to invite you to provide feedback about our products and services in the form of online or in-cinema surveys. We use this information to help us improve the quality of service provided by our staff and in our cinemas. We also use your feedback to monitor the quality of our products and services, to develop our business and to assist with the selection of future product and service lines.

It is in our legitimate business interests to use the information you provide to us in your feedback for the purposes described above. 
 
4.5 Customer insight and analysis. 
We analyse your contact details and other information provided by you during your use of the Sites and our Services, including your date of birth, with other personal information that we collect or observe about you from your interactions with our Sites, our email communications to you and/or with our products and services in our cinemas, such as the products and services you have purchased or viewed. 
 
Where you have given your consent (where lawfully required), we use cookies, log files and other technologies to collect personal information from the computer hardware and software you use to access our Site, or from your mobile. This includes the following:
 
• an IP address to monitor Site traffic and volume;
• a session ID to track usage statistics on our Site;
• information regarding your personal or professional interests, demographics, buying habits, experiences with our products and contact preferences. 

Our web pages and e-mails contain “cookies” "web beacons" or “pixel tags.” (“Tags”). Tags allow us to track receipt of an e-mail to you, to count users that have visited a web page or opened an e-mail and collect other types of aggregate information. Once you click on an e-mail that contains a Tag, your contact information may subsequently be cross-referenced to the source e-mail and the relevant Tag.
 
In some of our e-mail messages, we use a “click-through URL” linked to certain websites administered by us or on our behalf. This information is used to create profiles and insights about your cinema habits and the cinema habits of our other customers and helps us to get to know our customers better. 
 
By using this information, we are able to measure the effectiveness of our content and how visitors use our Site and our Services. This allows us to learn which pages of our Site are most attractive to our visitors, which parts of our Site are the most interesting, how customers use our Services and what kind of offers our customers like to see. 
 
We also use this information to help us with the selection of future product and service lines, cinema, website and app design and development, to identify appropriate partners whose offers we might obtain for you as a Cinema City customer and to remember your customer preferences.

  • Social media remarketing. 
    We use information that we observe about you from your interactions with our Site, our email communications to you and/or with our products and services in our cinemas (see the Customer Insight and Analysis section above for more details of the information collected and how it is collected) to provide you with personalised advertising on social media channels operated by Facebook and/or Google where you are a registered user of such services. 
We do this using Facebook Customer Audiences and/or Google Customer Match respectively. Please note that such activity requires that we share your encrypted email address with Facebook and/or Google and is also subject to the privacy choices you have elected to make on such services.
 
What is our legal basis?
Where your personal information is not in an anonymous form, it is in our legitimate interest to use your personal information for marketing purposes.
 
  • Social media insight. 
    Where you are a registered user of Facebook, or of a Google service, we may use your email address in an encrypted format to enable Facebook and Google to find other registered users of their services that share similar interests to you based on:
    • information that we observe about you from your interactions with our Site, our email communications to you and/or with our products and services in our cinemas (see the Customer Insight and Analysis section above for more details of the information collected and how it is collected); and
    • the information Facebook and/or Google hold about you. 
We do this using Facebook Lookalike Audiences and/or Google Similar Audience respectively. Please note that such activity is subject to the privacy choices you have elected to make on such services.
 
What is our legal basis?
Where your personal information is not in an anonymous form, it is in our legitimate interest to use your personal information for marketing purposes. 
 
  • Use of Anonymised Personal Information 
Where your personal information is completely anonymised, we do not require a legal basis to use it as the personal information will no longer constitute personal information that is regulated under data protection laws. 4.7 Business administration and legal compliance. 

 

We use your personal information for the following business administration and legal compliance purposes:
• to comply with our legal obligations;
• to protect our business and your accounts from fraud and other illegal activities 
• to enforce our legal rights or obligations;

• in connection with a business transition such as a merger, acquisition by another company, or sale of all or a portion of our assets.

Where we use your personal information in co nnection with a business transition, enforce our legal rights, or to protect the rights of third parties it is in our legitimate interest to do so. 4.8 Health and Safety 
We may use your personal information which is gathered for health and safety purposes including any accident report or claim log in respect of an accident or incident which occurs in one of our cinemas. As this may be data relating to your health it could fall within special categories of data which is defined under relevant data protection legislation as including personal data revealing racial or ethnic origin, religious beliefs and data concerning health (as well as various others). We may also use this information to establish, exercise or defend any legal claim in relation to the accident or incident, including sharing this information with our insurance providers. . 
What is our legal basis?
Where we use your personal information in connection with an accident or incident as described above it is in our legitimate interest to do so and to comply with our legal obligations.   Where this includes use of special categories of data it is necessary for the purposes of carrying out our obligations and exercising specific rights relating to relevant social protection law which may include health and safety and/or occupiers liability legislation. In addition where we also process special categories of data to establish, exercise or defend any legal claim we do so because it is necessary to process it for these purposes.  
 
4.9 Other purposes
Any other purposes for which we wish to use your personal information that are not listed above, or any other significant changes we propose to make to the existing purposes will be notified to you using your contact details. 5 HOW DO WE OBTAIN YOUR CONSENT?

• providers of ticketing systems; 
• providers of systems that help us provide and administer our gift products; 
• agencies that provide us with cinema staff members;

• suppliers who host, provide, manage, support or administer certain aspects of our websites, and customer services facilities, 
• suppliers who host, provide, manage, support or administer certain aspects of our IT and business administration systems and data centres;

• suppliers of email, online and social media advertising and other marketing services and systems;
• third parties who help us to run or administer competitions or deliver prizes;
• third parties who host our events;

• any other third party where we are obliged to, or permitted to do so, by law, court order or to comply with any search warrant or similar instrument presented to us by any law enforcement, government officer or regulatory authority;
• in the event that our business is sold or integrated with another business, our lawyers, and other professional advisers, any prospective purchasers' lawyers and professional advisers, and any prospective purchaser (subject to duties of confidentiality).
 
8 TRANSFERS OF YOUR PERSONAL INFORMATION OVERSEAS
8.1 Internally within our group
We transfer your personal information within our group as described in section 7. 
The use of your personal information is governed by an intra-group agreement and although we do not routinely transfer your personal data from the EEA to a non-EEA jurisdiction if we do so in the future we will ensure that there is a lawful basis for transferring personal information outside the EEA, this may include use of EU ‘model clauses’ which have been approved by the European Commission.

8.2 To external third parties
Some of the third parties that we describe in section 7 may be located outside of the EEA or may otherwise transfer your personal data outside of the EEA.
Where we transfer your personal data to external third parties, we take appropriate steps to ensure that your personal information is treated securely and in accordance with this Privacy Policy and all applicable laws. 
 
In respect of transfers of your personal information outside of the EEA, this means that we will ensure that there is a lawful basis for transferring personal information outside the EEA. Our standard practice is to use ‘model clauses’ which have been approved by the European Commission for such transfers. 10 HOW LONG DO WE KEEP YOUR PERSONAL INFORMATION FOR?
Whenever we collect or process furtherly your personal data we will usually keep it for one year after our last interaction with you or otherwise in accordance with our data retention policy. We will keep personal data you give us in relation to any contract that we have with you for the maximum period of three (3) years, according to limitation period. If your information is only useful for a short period e.g. for specific marketing campaigns we may delete it. At the end of that retention period, your data will either be deleted or anonymised, for example by aggregation with other data so that it can be used in a non-identifiable way for statistical analysis and business planning. We keep the length of time that we hold your personal data for under review.
 
11 CONFIDENTIALITY AND SECURITY OF YOUR PERSONAL INFORMATION
We are committed to keeping the personal information you provide to us secure and we will take reasonable precautions to protect your personal information from loss, misuse or alteration.

12 HOW TO ACCESS YOUR INFORMATION AND YOUR OTHER RIGHTS

If you ask us, we’ll confirm whether we’re processing your personal information and, if so, provide you with a copy of that personal information (along with certain other details). If you require additional copies, we may need to charge a reasonable fee.

If the personal information we hold about you is inaccurate or incomplete, you’re entitled to have it rectified. If we’ve shared your personal information with others, we’ll let them know about the rectification where possible. If you have an online account, you can log in and amend your contact details and email and text marketing preferences whenever you like.

If we’ve shared your personal information with others, we’ll let them know about the erasure where possible.   • Your right to restrict processing.
You can ask us to ‘block’ or suppress the processing of your personal information in certain circumstances such as where you contest the accuracy of that personal information or you object to us processing it. It won’t stop us from storing your personal information though. We’ll tell you before we lift any restriction. If we’ve shared your personal information with others, we’ll let them know about the restriction where it is possible for us to do so. If you ask us, where it is possible and lawful for us to do so, we’ll also tell you who we’ve shared your personal information with so that you can contact them directly.

With effect from 25 May 2018, you have the right, in certain circumstances, to obtain personal information you’ve provided us with (in a structured, commonly used and machine readable format) and to reuse it elsewhere or to ask us to transfer this to a third party of your choice.

You can ask us to stop processing your personal information, and we will do so, if we are:

You can ask us to stop sending you marketing communications sent to you by email at any time by using the ‘opt-out’ or ‘unsubscribe’ link that we will present to you in the marketing communication.
